Our product MojiWeather App (the “Application”) is an application that provides you with weather information query and information services. While providing weather information services, MojiWeather provides you with a diversified product experience, including but not limited to sharing Real-Time-Scene pictures and providing you the access to browse, communicate and share in the interactive community. MojiWeather also cooperates with third parties to provide you with more abundant information services.Please read this Privacy Policy carefully before using our products or services to ensure that you are fully aware of and understand its contents, especially the meaning of the bold content and the corresponding legal consequences. By checking the box and clicking “Agree”, you are deemed to have accepted this Privacy Policy, and you agree that this Privacy Policy is valid and binding on you throughout the entire process of your use of this Application. If you provide us with the personal information of other third parties, please ensure that you have obtained full authorization from the third parties. Below are the reasons we process your Personal Information:
(1) Basic business functions to provide you with the Application
In order to better protect the network security when you use our services, maintain the normal operation of the Application and improve our services, after you agree to this Privacy Policy, when using the weather information services we provide, in addition to the Personal Information necessary to ensure the normal operation of the basic functions of the Application as required by laws and regulations, we will collect other Personal Information from you, and certain device information when you use the Application (including device model, Android ID, OAID, IDFA, Open UDID, GUID, SSID) , operating system version, resolution, telecom operator, device settings, log information (“Device Information”) when you use this Application (including the search keyword information you enter and the links you click, the content you browse, the language you use, the access date and time, the web page record you request, software version number and login IP information). Since the weather information delivery service requires the Application to be in an independent process, we need to obtain your applications under process to ensure that messages are delivered in a timely manner . To provide better services in this Application, we may also collect data to produce statistics, for which purpose we will also collect your above Device Information, including device unique identifier, when your device is in the background/quiet state.
(2) Provide you with expanded business functions of the Application
In addition to weather information, we also provide you with expanded business functional information services, which include news information, Real-Time-Scene pictures, short videos, Mo Quan community and third-party commercial promotion information published by us. In the process of providing the above information services, we will also collect the information required for the above basic business functions. In addition, for the purpose of providing you with personalized content display and customized advertising recommendations, we will use big data analysis, algorithms and other non-manual automatic decision-making technologies for the above Device Information we directly collect to carry out tag processing and to form User portraits to make automated decisions (such as commercial information display). At the same time, we may cooperate with data analysis service providers and performance advertising service providers to indirectly obtain your other group tag information, which may involve your Personal Information to provide you with more accurate personalized content display and advertising recommendation services. For details about the Personal Information we obtain indirectly from third parties, please see Section “(4) We may obtain your Personal Information indirectly from third parties” in this Chapter.
We undertake that in the process of using User portraits, we will not infringe upon the legitimate rights and interests of citizens, legal persons and other organizations, and will not endanger national security, honor and interests. If you have any questions in relation to the results of automated decision-making when you use the Application, or think the results of automated decision-making are incorrect which lead to a negative impact on you, or you want to turn off personalized content display, please contact us for an explanation or request for a manual review of the automated decision-making results through the contact information disclosed in Chapter 9 of this Privacy Policy, and we will provide you with ways to opt-out or other appropriate relief methods. If you want to turn off the personalized recommendation function, you can click [Settings] - [Personalized Settings] on the upper right corner of the [Me] page of the Application. On the personalized setting page, you can choose to turn off [Personalized Ads] [Personalized Real-Time-Scene] [Personalized information content] [Personalized card] functions.You can also opt out of interest-based advertising on mobile apps by checking your Android or iOS device's privacy settings and selecting “Limit ad tracking” (Apple iOS) or “Opt out of interest-based advertising” (Android). In addition, in certain circumstances, you may be able to use the settings of a third-party ad provider for the purposes described above. After any of such functions is turned off, you will not receive personalized recommendation information based on your User portraits or tags that we have made, but this will not affect the quantity and display of ordinary advertisements or content. We emphasize that the Applications released in car, watch, and TV systems do not include the functions of personalized content display and customized advertising recommendation.
We also provide you with the following other extended business functions and may also need to collect the following information. If you refuse to provide the following information, it will not affect your use of the basic business functions described in Section (1) of Chapter 1of this Privacy Policy, but we will be unable to provide you with certain specific functions and services:
(a) When you log in your Moji Account:
When you log in this Application, you need to provide us with your mobile phone number, or a Third Party Account that belongs to you, e.g. WeChat account information (including WeChat nickname and profile image), Google account information (including email, profile image), Facebook account information (including Facebook nickname, profile image) or Apple account information (including Apple ID, profile image) (“Third Party Account”) to create a Username, ID and password. If we need to collect other information from you due to requirements of third-party regulators, suppliers, service providers, etc., we will inform you on the authorization page and obtain your authorization first. If you use a Third Party Account to login, you need to authorize us to collect your Third Party Account information from the corresponding third-party platform. You can provide more additional information to complete the relevant “Personal Information” sector of this Application in your subsequent use, such as your nickname, gender, date of birth, place of residence. Such information will help us provide you with better services, but failure to provide it will not affect your use of MojiWeather’s services. Please note that in the absence of special settings or statements, the content and information you actively provide, including your Personal Information upload or publish on the Application may be publicly accessed and used by third parties. We will try our best to protect your Personal Information, but we cannot completely exclude the risk of your Personal Information being leaked to the public domain. Please be cautious and careful when considering whether to provide, upload, share or publicly disclose the relevant information on the Application.
(b) When you post information:
After logging in this Application, you can post content in sections such as Real-Time-Scene and Mo Quan, and you can post comments in sections such as Real-Time-Scene, Mo Quan, and short videos. When you use the relevant content publishing section functions such as Real-Time-Scene, Communities or Forums, you can actively provide, upload or publish contents and information (such as pictures containing your image or other Personal Information, etc.). Please note that in the absence of special settings or statements, the content and information you actively provide, including your Personal Information upload or publish on the Application may be publicly accessed and used by third parties. We will try our best to protect your Personal Information, but we cannot completely exclude the risk of your Personal Information being leaked to the public domain. Please be cautious and careful when considering whether to provide, upload, share or publicly disclose the relevant information on the Application. When using the Real-Time-Scene service, you may be required to authorize the use of cameras, photo albums (photo gallery) and geo-location access for the purpose of acquiring the images you need to upload and their location information.
(c) When you use the follow function of Moji Community: We will collect your followed content and follow list information, establish and manage community user contents and follower relationships between Users, so as to send notifications of the updates for your followed objects to you.
(d) When you use location weather services, browse and publish pictures and other content, personalized content display and advertising and services for local information: When you turn on the device location function and use such related services provided by MojiWeather, we will collect information about your location (including IP address, GPS location information and WI-FI access points, Bluetooth, and base stations that can provide relevant information). If you use the real-time weather update function, in order to timely update the weather information of your location, we will also collect your location information when your device is in the background/silent state. Before turning on the real-time weather update function, we will additionally ask you for authorization.
(e) When you use the earthquake warning service: You can use this function to obtain earthquake warning information prompts and sound broadcasts. When you turn on the device locating function and use related services provided by MojiWeather, we will collect information about your location (including IP address, GPS location information, and sensor information such as WI-FI access points, Bluetooth, and base stations that can provide relevant information).
(f) When you share: In order to respond to your off-site sharing request, when you share the content of the Application, we may obtain your nickname, profile image, ID and other information on third-party platforms, such as WeChat, Facebook, Google or other sharing websites.]
(g) When you use functions involving payment: Payment for transaction orders on the Application is completed through the payment services provided by third-party cooperative payment institutions (WeChat Pay, Apple Pay). Please note that during the payment process, the third-party payment service may require you to provide your biometric information for payment verification. Please read the privacy policy of the third-party institution carefully when using the third-party payment service. If you do not agree to the third-party privacy policy, please stop using the third-party payment service immediately. When you use third-party payment services, we cannot and will not collect, store and use your biometric information.
(h) When you apply for official verification: In order to verify your identity and the verification content you are applying for, you can voluntarily provide and upload your ID card, pictures and verification materials containing your image or other Personal Information. ID cards and supporting documents may contain your Personal Sensitive Information. We undertake that Personal Sensitive Information and other information and materials uploaded for official verification will only be used for official verification review purpose, and we will adopt technical methods such as encrypted storage to strengthen privacy protection to protect them from being leaked. However, please be cautious and careful when considering whether to apply for official verification.
For the purpose of verification, for online accounts that produce and publish text, pictures, audio and video and other information content for the public, we will collect the ID card and/or institution registration information of the User in accordance with laws and regulations to maintain public communication order. Except for the above circumstances, we do not have compulsory requirement of the collection of the User ID cards and/or institution registration information.
(i) When you use the Parent-Child Mode: We do not actively collect information of Children User, but you can choose whether to provide the Children information under the Parent-Child Mode provided by MojiWeather. Please note that without special settings or statements, you may not be able to activate the Parent-Child Mode, and if the Children profile image you actively set contains the image of your Children, it may be obtained and used by a third party. We cannot exclude the risk of Children’s Personal Information being leaked to the public domain. Please be cautious and careful when considering whether to provide, upload, share or publicly disclose the relevant information on the Application. The information of the nickname, birthday information, and gender of the Children will help us provide you with more personalized services under the Parent-Child Mode, but failure to provide them will not affect your use of the basic services of the Application under the Parent-Child Mode. We treat Children’s Personal Information as Personal Sensitive Information, and we undertake to only use the Children information you provide for the purpose of providing personalized parent-child services. We will adopt technical means such as encrypted storage and transmission to ensure that Children’s Personal Information is protected as strictly as possible. You may withdraw your consent for the processing of such Personal Information any time or request us to delete Children’s Personal Information by contacting us through the contact information disclosed in Chapter 9 of this Privacy Policy. Regarding the protection rules for Children’s Personal Information, you can refer to Chapter 6 of this Privacy Policy for details: “How we process Children’s Personal Information”.
(j) When you participate in operational activities or contact us: You can participate in the operational activities organized by MojiWeather (such as draws, contests, questionnaires, answer questions, etc.), or contact us for error reporting, complaints, etc. You may voluntarily provide your name, contact number, contact address and other Personal Information based on our request, and you may decide whether to provide such Personal Information to proceed with the actions. For specific activities such as cash withdrawal, prize redemption, tax declaration, etc., we may also need you to provide your Personal Sensitive Information, such as your ID card information. MojiWeather will also access your clipboard after entering the homepage to determine whether there is card and coupon information that can be copied or pasted, which can be used in scenarios where you need to receive cards and coupons to participate in activities, making it easier for you to participate in activities more quickly.
(k) When you use the health function: In order to assist the third-party service provider (such as Ping An Good Doctor) to provide you with accurate medical advice and provide nearby expert consultation services, we may need to collect your precise locating information. Before collecting this information, we will prompt a pop-up window on the page to seek for your authorization. Please note that your location information may be shared with a third-party service provider (Ping An Good Doctor).
(l) When you use the gold coin center function: For User identification, we will collect your device identifier information. Please note that your Device Information will be shared with our third-party partners.
(m) When you use travel activities or health step counting and other activities, we will obtain your walking, step counting, location and other information on your mobile phone in order to provide you with step counting rankings, step counting statistics and other content.
(n) In addition, when you use “taxi-hailing service”, MojiWeather will provide you with access to the third-party taxi-hailing platforms to provide scheduled taxi-hailing services. During this process, MojiWeather will obtain your precise location information and mobile phone number to help you identify the starting point for online taxi reservations and enable the taxi-driver to contact you in time.
(o) When you use other travel services to order travel products, MojiWeather will provide travel product booking services by connecting you to a third-party travel platform. During this process, MojiWeather will indirectly obtain your precise location information and mobile phone number through a third party platform which provides the relevant services, so as to recommend you surrounding attractions or airports, etc., to help you complete the purchase of services, or send you a booking voucher.
(p) When you try to enter a third-party application through MojiWeather, we, or the third party we cooperate with will ask your device whether you have installed the third-party application.
(q) When you use the desktop plug-in, in order to ensure the real-time and accuracy of the desktop plug-in data, we need to use the auto-start service. If this service is turned off, the desktop plug-in may not be used normally.
(r) In addition to the above, when we plan to use information for other purposes not specified in this Privacy Policy, we will obtain your explicit consent in advance separately.
(s) In some jurisdictions, certain types of Personal Information, such as information about your race, religious, political or philosophical views and sexual orientation, are characterized as Personal Sensitive Information and are subject to stricter regulation than other types of Personal Information. We do not require you to provide such Personal Sensitive Information to use the services we provide. By posting or communicating any such Personal Sensitive Information in the Application, you provide your consent to such information being available within the Application.
(3) Device permission
MojiWeather may seek for certain permissions for access to the certain functions or applications of your device. Below is a breakdown of the permissions required for Android and iOS systems, including the corresponding business functions, the purposes of seeking such access permissions, and the timing of seeking your authorization. The method of displaying permission requests and how to turn them off may vary in different devices using the Android system. In order to protect your privacy, please read carefully and understand our access to the relevant functions and applications of your device.

When you use certain device permissions for the first time under certain scenarios, we will ask you to open the corresponding permissions through a pop-up window and authorize us to collect and use the corresponding Personal Information to provide specific services. If important or sensitive device permissions are involved, we will ask for your explicit consent in a separate pop-up window when you use the corresponding services before enabling the corresponding device permissions.
After the permission accesses are completed, you can choose to turn on or off the corresponding permissions any time in the system settings function of the device, thereby allowing or denying us to collect and use your Personal Information. However, please note that turning off the corresponding permissions will affect the normal use of the corresponding business functions of this Application. You can also manage device permissions through the permission settings page of this Application. For details, please see Part 5 “How do you manage your Personal Information”.
We undertake not to access device permissions in scenarios without your authorization or use Personal Information collected by accessing device permissions for scenarios without your consent.
(4) We may obtain your Personal Information indirectly from third parties
(a) Third-party authorized login
When you log in using Third Party Account (e.g. WeChat, Facebook, Google etc.), you can choose to authorize MojiWeather to read and obtain your public information (including nickname, profile image) registered, published and recorded on the third-party platform in compliance with relevant laws and regulations.
MojiWeather requires your authorization to obtain the above information from a third party in order to remember your login identity as a Moji User so as to provide you with better products and/or services. We will only collect and use your Personal Information within the scope of your authorization and consent. After you register or log in with Third Party Account, your Third Party Account will be bound to your Moji Account, but you can choose to cancel the account binding in [Settings → Account Management→ Social Account Binding].
(b) Use or order third-party services
MojiWeather provides you with access to various third-party services. You can enter the third-party page through the function icon or information page to use third-party services. For example, after querying travel information, you can use third-party platforms to reserve hotels, purchase tickets, and book train tickets and air tickets. MojiWeather will indirectly obtain your transaction information (including transaction time and service price, subject to the specific transaction contents) through the third party platform that provides the services, and such information will be used to display your transaction for you on the Application and provide you with inquiry and client services.
(c) Form User group portraits
In order to provide you with personalized content display and customized advertising recommendation services more accurately, we may cooperate with third-party partners for data sharing. With your authorization and consent, we may share your phone number, Device Information, location information with third parties, and indirectly obtain your portraits tag information from third parties. The tag information may contain information that directly reflects your personal status, including gender, age group, city, mobile phone model, and interests and hobbies. For details on how we share information with third parties, please see Chapter 3 of this Privacy Policy: “How we share, transfer and publicly disclose your Personal Information”.
The User tag information we indirectly obtained above is mainly based on the algorithm inference results of third-party partners, which we will use for automated decision-making on personalized content recommendations and customized advertising. If you think that the automated decision-making results are wrong or have affected your User experience, you can ask us for an explanation, request manual review of the automated decision-making results, request correction of the tag information or withdraw the corresponding consent through the contact information disclosed in Chapter 9 of this Privacy Policy. We will promptly respond to your request and will provide you with ways to opt-out or other appropriate relief methods.
We undertake to obtain your explicit consent before indirectly collecting your Personal Information. However, at the same time, please be aware and understand that when the type or method of obtaining your Personal Information changes and when this Privacy Policy is not adjusted in a timely manner, we will ask for your re-authorization through pop-up prompts, text messages or email notifications.
In addition, this Privacy Policy cannot be used as a privacy protection clause for third-party services. We strongly recommend that you read and understand the specific content of the service agreement and privacy policy of the third-party services before using the them, and understand the rules of collecting and using Personal Information from you by third-party services, the protection they can provide and the right you have as the subject of Personal Information.
(5) Commercial utilization
After collecting your Personal Information, we may perform automated data processing on your Personal Information. In this case, we will de-identify and/or anonymize the data in accordance with common national technical standards to form a User Database. On the premise of not infringing on your personal privacy and complying with the Personal Information protection policy, we have the right to mine, analyze and utilize the database commercially.
(6) Exceptions to seeking consent
In the following situations, we may not seek your consent in advance to acquire relevant information:
(a) related to the performance of obligations stipulated in laws and regulations by the controller of the Personal Information;
(b) directly related to national security and national defense security;
(c) directly related to public safety, public health, and major public interests;
(d) directly related to criminal investigation, prosecution, trial and judgment execution;
(e) to protect your or others’ lives, property and other major legitimate rights and interests, and it is difficult to obtain your consent in a timely manner;
(f) the Personal Information collected is disclosed to the public by yourself;
(g) necessary to sign and perform a contract at your request;
(h) your Personal Information that can be collected from legally publicly disclosed information, such as news reports, government information disclosure and other channels;
(i) necessary to maintain the safe and stable operation of the products or services provided, such as discovering and handling product or service failures;
(j) when it is necessary for academic research and the results of academic research or description are provided to the outside world after the Personal Information contained in the results is de-identified; or
(k) other situations stipulated by laws and regulations.
(1) Cookie
To ensure the normal provision of our products and/or services, we will store small data files named cookies on your computer or mobile device. Cookies usually contain an identifier, a site name, and some numbers and characters. With the help of cookies, we can store data such as your preferences or collections. We will not use cookies for any purpose other than those stated in this Privacy Policy.
(2) Website beacons and pixel tags
In addition to cookies, we will also use other similar technologies such as web beacons and pixel tags. For example, emails or notifications we send you may contain URLs linking to our products and/or services. If you click this link, we will track this click to help us understand your preferences for product or service and improve our customer service.
(3) Do Not Track
Many web browsers have a Do Not Track function, which can issue Do Not Track requests to websites. Currently, the major Internet standards organizations have not established policies that specify how websites should respond to such requests. But if your browser uses Do Not Track function, we will respect your choice.

We will not share your Personal Information with any company, organization or individual outside of MojiWeather, except in the following circumstances:

(b) Share as required by laws and regulations, or in accordance with the mandatory requirements of government authorities;
(c) Share with our affiliated company: We will share necessary Personal Information within the reasonable scope necessary to perform the contract for providing services to you, and subject to the purposes stated in this Privacy Policy. If the affiliated company wants to change the purpose of processing Personal Information, we will ask for your authorization and consent again; or
(d) Share with third-party partners: In order to enrich service contents, we will work with third-party partners to provide you with services, and collect and share your Personal Information with these third-party partners in accordance with the mandatory provisions of laws and regulations and/or the requirements of our partners. We undertake to share your Personal Information with our third-party partners only for specific and clear purposes based on legal principles of legality, legitimacy, and necessity. Our third-party partners have no right to use the Personal Information obtained based on this Privacy Policy for any other purpose unless you reach a new agreement with our third-party partners. Please understand that if you refuse us to share your Personal Information with the relevant third-party partners, you will not be able to use the corresponding services.
What needs to be specifically drawn to your attention is that when the relevant service provider provides you with services through a third-party access method such as jumping to the third-party partner’s page, the corresponding service provider will directly reach an agreement with you on the corresponding authorized use of Personal Information. The Personal Information collected directly by service providers is not within the scope of Personal Information we share with them.
Our current third-party partners include the following: providers of functions and technical services as well as advertisers and their agents. We may share your Personal Information with third-party partners that support our business functions. These supports include confirming your geographical location information, map services, third-party payment services, login authentication services, performance advertising delivery and tracking, User portraits, information flow content, notification services, network security, anti-fraud, statistical analysis and advertising monitoring. Our purpose of sharing such information is to obtain technical support for related functions to achieve business functions.
In order to display personalized advertisements to you and to display personalized advertisements on other websites and services (including email), we may share the information we collect with advertising vendors or the advertising vendors themselves may access, collect and share your information. We have a legitimate interest in processing the data necessary so that they may (i) provide and/or support the delivery of relevant content or advertisements on our websites or applications, on the websites or applications of advertising vendors, or on the websites or applications of other third parties, (ii) analyze and report on content or advertisements viewed or interacted with by Users, and (iii) improve their services. Advertising providers may also collect information through the technologies discussed above or through interactive advertising. Information may include data about how users interact with the Services, information provided by users through interactive advertisements, content and advertisements viewed by users, user activity on other Web sites and online services, and physical locations visited by users. These partners may have access to your data and operate under their own privacy policies. We encourage you to check their privacy policies to learn more about their data processing practices. If you decline to receive personalized advertisements, you may exercise your right to do so in the manner disclosed in Chapter 5 of this Policy, “Changing the Scope of Authorization and Consent”. We will remind you of the specific third-party partners who provide services before jumping to the third-party page or on the in-site page where the third-party partners provides services, and we will make reasonable commercial efforts to require our third-party partners to maintain a fairly consistent privacy protection practice with us. (b) Comply with relevant agreements signed with you (including electronic agreements signed online and corresponding platform rules) or other legal documents; or
(c) When a merger, acquisition or bankruptcy liquidation is involved, if Personal Information needs to be transferred, we will require the new company or organization that obtains your Personal Information after the above merger, acquisition or bankruptcy liquidation to continue to be bound by this Privacy Policy, otherwise we will require the company or organization to re-ask for your authorization and consent.
(3) Public disclosure
We will only publicly disclose your Personal Information under the following circumstances:
(a) After obtaining your explicit consent; or
(b) When required by law, legal proceedings, litigation or government authorities. When we receive the above request to disclose Personal Information, we will require for corresponding legal documents, such as subpoenas or letters of inquiry.
We have adopted various security technologies and protective measures that comply with industry standards to protect your Personal Information from unauthorized access, use or leakage. For example, when you exchange data with our server, we use technology such as HTTPS, SSL, AES, etc. to ensure data security and confidentiality. We will strictly follow domestic and foreign security standards to build a security system, and implement it in combination with cutting-edge and mainstream security technologies to prevent User’s Personal Information from being accessed, used, and leaked without authorization. We have established a complete security defense system that enables us to proactively intercept and respond to external cyber-attacks and virus infections in a timely manner. MojiWeather’s weather data service system and advertising delivery engine system have passed the filing and evaluation of Level 3 and Level 2 National Information System Security Registration Protection respectively.
We have formulated strict access specifications and review mechanisms for the SDKs (Software Development Kits) integrated in this Application to ensure that the access and acquisition of your Personal Information by these SDKs (Software Development Kits) is limited solely to the extent necessary to fulfill their functions or services.
We have established and improved a data security management system, including grading, classifying and encrypting User’s Personal Information, and dividing data access permissions. We have formulated an internal data management system and operating procedures, and have strict process requirements for data acquisition, use, and destruction for preventing your Personal Information from being illegally used. We will regularly hold security and privacy protection training to improve employees’ awareness of Personal Information protection. However, you should understand that due to technical limitations and possible hostile cyber-attacks, in the Internet industry, even if we do our best to strengthen security measures, we cannot guarantee 100% security of information, including your Personal Information. There may be factors beyond our control which may lead to information leakage. If a Personal Information security incident unfortunately occurs, we will promptly inform you of the basic situation, the possible impact of the security incident, the emergency response and other related measures we have taken or will take, and the remedies for you, etc. in accordance with the requirements of laws and regulations through in-site messages/contact information you have reserved. If it is difficult to notify subjects of such Personal Information one by one, we will issue announcements in a reasonable and effective manner and proactively report the handling of Personal Information security incidents to relevant regulatory authorities.
If you find that your Personal Information has been leaked, please contact us immediately through the contact information agreed in this Privacy Policy so that we can take appropriate measures in a timely manner.
We will do our best to adopt appropriate technical means to ensure that you can access, update and correct your registration information or other Personal Information provided when using our products and/or services.
(1) Access your Personal Information
You can access your Personal Information through your device in the following ways:
(a) Account information - You can log in, click “Me” to enter your personal homepage, then click your profile image to enter “Personal Information – Edit” to perform such operations.
(b) Real-Time-Scene search information -You can log in to your account, click on the search box and select to view of clear your search history.
(c) Forum information - You can log in to your account and enter Mo Quan to view, edit or delete the information you posted or commented on.
(d) Parent-Child information - You can log in to the Parent-Child section to view, edit or delete the Children’s information you provided.
(e) Other information - Log in to your account and click “Me” to enter your personal homepage and edit or delete your transaction information, follow information, and collection information.
(2) Correct or supplement your Personal Information
When you find errors in the Personal Information we process, you can ask us to make corrections or additions. For contact details, please see How to Contact Us in Chapter 9 of this Privacy Policy.
(3) Delete your Personal Information
You can change the scope of your Personal Information that you authorize us to collect and use by logging in to your personal account to delete information, turn off related device/tool functions, and adjust privacy settings in the Application. You can also cancel all our authorization to collect and use your Personal Information by cancelling your account. After you cancel your account, we will stop using and then delete your Personal Information, unless otherwise provided by laws and regulations or otherwise agreed in writing with you.
You can make a request to us to delete your Personal Information under the following circumstances:
(a) Our processing of Personal Information violates laws and regulations or our agreement with you;
(b) We fail to obtain your explicit consent to collect and use your Personal Information; or
(c) We terminate the provision of our products or services to you or you voluntarily terminate the use of our products or services.
If you are unable to access, update or delete such Personal Information through the above paths, you can contact us at any time through the contact information provided in Chapter 9, and we will respond to your request within fifteen working days.
When you delete your Personal Information, we may not delete the corresponding information from the backup system immediately, but we will delete the information when the backup is updated. We will delete your Personal Information when you cancel your account, except for anonymized information that has been used for User portraits or cannot be deleted in accordance with laws and regulations.
When we anonymize or delete your Personal Information, if your Personal Information has been shared, we will also notify the relevant companies, organizations or individuals to anonymize or delete your Personal Information.
(4) Change the scope of your authorization and consent
(a) You can change the camera, location, or other access permissions in your mobile device. You can also enter the “Me” page in the Application, click the “Settings” icon in the upper right corner, and enable or deny device permissions through “Application Permissions”.
(b) If you do not want to accept the notifications we send you, you can enter your personal homepage by clicking “Me”, click the “Settings” icon on the upper right corner, and then close the relevant notification settings.
(c) If you do not agree to accept personalized ads or personalized content notification, you can enter the “Me” page in the Application, click “Settings” – “Personalized Settings” on the upper right corner, and click buttons displayed on the “Personalized Settings” page to close personalized notification. You can also opt out of interest-based advertising on mobile apps by checking your Android or iOS device's privacy settings and selecting “Limit ad tracking” (Apple iOS) or “Opt out of interest-based advertising” (Android). In addition, in certain circumstances, you may be able to use the settings of a third-party ad provider for the purposes described above.
(5) Cancelling an account
You can click “Me” on the Application at any time to enter the personal homepage, then click “Settings” and then select “Account Management” to enter the account management page and choose to cancel the account, or contact us to cancel the your account by referring to the contact information provided in Chapter 9 of this Privacy Policy. After cancelling your account, we will stop providing products or services to you and delete your Personal Information according to your request, unless otherwise provided by laws and regulations.
(6) Obtaining a copy of Personal Information
You have the right to contact us through the contact information listed in Chapter 9 of this Privacy Policy to obtain a copy of your basic information, identifiable information and other Personal Information that we have collected.
(7) Respond to your above request
To ensure security, when you make the above requests, we may ask you to verify your identity before processing your request. Normally, we will respond to your request within fifteen working days. In principle, we do not charge fees for your reasonable requests, but for repeated requests that exceed reasonable limits, we will charge certain fees depending on the circumstances.
Under the following circumstances, we will not be able to respond to your request due to the legal and regulatory requirements:
(a) related to our performance of obligations stipulated in laws and regulations;
(b) related to national security and national defense security;
(c) related to public safety, public health, and major public interests;
(d) related to criminal investigation, prosecution, trial and judgment execution;
(e) there is sufficient evidence that you have malicious intention when using the Application and the relevant products and services we provide or abuse your rights;
(f) respond to your request will cause serious damage to the legitimate rights and interests of you or other individuals or organizations; or
(g) the operation in response to your request may be at risk of disclosing or leaking trade secrets.
We do not provide services to Children or any person under the Age of Majority that has not obtained the approval by the User’s parent or guardian. Age of Majority, for the purpose of this Privacy Policy, means the age of 18, or such an age at which under the applicable laws the person is allowed to use this Application without obtaining the consent or permission from this person’s parent(s) or guardian. If you are a Child, please stop using our services immediately. If you are over the age of 13 (including 13), but you have not reached the Age of Majority, you will need to obtain your parent(s) or guardian’s approval and MojiWeather’s consent before proceeding to use this Application. You should clearly understand that if we discover or have reason to believe that you may be a Child during the service, we may suspend or terminate the service to you until you provide us with proof that you are over the Age of Majority or you have obtained your guardian’s explicit consent. For cases where Children’s Personal Information is collected with parental consent, we will only use or publicly disclose this information when permitted by laws, with the explicit consent of guardians, or when it is necessary to protect the Children. We do not push personalized ads to users known to be children that are specific to their characteristics. If we discover that we have collected Children’s Personal Information without prior consent from guardians, we will delete the relevant data as quickly as possible.
Some sections of the Application may collect Children’s Personal Information based on your voluntary provision. Please ensure that you, as the Children’s guardian, have obtained legal authorization to provide Children’s Personal Information. We also strictly abide by the protection requirements for Children’s Personal Information, and we will collect, use, share and disclose Children’s information within the authorized scope, and take necessary technical measures such as encryption to protect Children’s Personal Information. If you make any request or would like to exercise any right regarding the Children’s Personal Information we have collected, please contact our Compliance Department according to the contact information disclosed in Chapter 9 of this Privacy Policy. They also serve as the Children’s Personal Information protection agency for MojiWeather.
The Personal Information that we collect from you will be transferred to, stored at, or processed in Singapore. Our provision of products and/or services globally, which means that, with your prior written consent, including the consent by agreeing this Privacy Policy, we may transfer or provide access of your Personal Information to jurisdictions other than the country in which you use the Application. For providing your Personal Information to third parties outside your jurisdiction, we will ensure that your Personal Information is protected to the extent no less than required by applicable laws, including through standard contractual clauses approved by the European Commission or other competent authorities.
We undertake at all times to store your Personal Information as required by laws, for a period reasonably necessary to achieve the purposes stated in this Privacy Policy. We determine the storage duration of Personal Information based on the following criteria:
(1) To provide you with our products and/or services and maintain relevant business records in response to any inquiry or complaint you may have;
(2) To ensure the safety and quality of the services we provide you;
(3) Your agreement to a longer storage duration;
(4) As required by the statute of limitations; and
(5) Other agreements or provisions of laws and regulations regarding the storage duration.
After the storage duration expires, we will delete your personal information or anonymize your Personal Information in accordance with the applicable laws.
If we cease operation, we will promptly cease the activities of collecting your Personal Information in accordance with applicable law, notify you of the cease of operation by delivering the notice one by one or making a public announcement, and delete or anonymize the your Personal Information.
Please understand that in order to bring you a better experience, we are continuing to work hard to improve our technology. As a result, we may launch new or upgraded functions from time to time, and may need to collect and use your additional Personal Information, or change the purpose or method of using your Personal Information. We will strive to implement the principle of “Privacy Protection”, improve our product design, and promptly explain to you the content, scope and purpose of Personal Information collection through page notifications, announcements or interactive processes, which would be deemed as supplemental to this Privacy Policy, unless otherwise explicitly provided.
We may revise this Privacy Policy from time to time. Please note that we may make necessary corrections to the paragraph format, text and errors in this Privacy Policy without your consent. Without your explicit consent, we will not reduce your rights in accordance with this Privacy Policy. For major changes, we will also notify you in more prominent ways, such as notifications on the Application, pop-ups, emails, etc., so as to keep you informed of changes to this Privacy Policy. The updated version will be published in the Service and Privacy Agreement section.
Significant changes to the Privacy Policy include, but are not limited to:
(1) Our service model has undergone significant changes, such as the purpose of processing Personal Information, the type of Personal Information to be processed, and the method of using Personal Information, etc.;
(2) We have undergone major changes in ownership structure, organizational structure, etc., such as changes in owners caused by business adjustments, bankruptcy and mergers and acquisitions, etc.;
(3) The third parties to whom your Personal Information is shared, transferred or publicly disclosed change;

For all information listed above, pursuant to the EU General Data Protection Regulation or any equivalent legislation, we process the personal information of User located in the European Economic Area, United Kingdom and Switzerland based on our contract with you.

Children
If you are under the age of 13, you should not use the Application.

· Internet or other electronic network activity information, including your device model, network type, OS type and version, client version, search history, log data, information related to third party accounts that you have linked to the Application, and survey information. Such information is collected directly from a device;
· Commercial information, including payment card information and transaction verification information. Such information is collected directly from the consumer or device;
· Audio, electronic, visual, or similar information, including a profile picture. Such information is collected directly from the consumer; and
· Other information that is described in subdivision (e) of Section 1798.80, such as nationality and gender (this information is being collected in the consumer context rather than the employer context). Such information is collected directly from the consumer.
We collect Personal Information for the following purposes:
· To operate and administer the Application;
· To communicate with User;
· To improve our services;
· For security and verification purposes, including to prevent and detect fraudulent activity; and
· To address and remediate technical issues and bugs.
For additional information about what each type of Personal Information is used for, see the main portion of the Privacy Policy.
We may disclose each of the categories of Personal Information identified in the Privacy Policy to the following types of entities:
· Other companies that provide services on our behalf who are prohibited by contract from retaining, using, or disclosing Personal Information for any purpose other than for providing such services to us;
· Regulators and judicial authorities and law enforcement agencies; and
· Entities that acquire all or substantially all of our business.
In the past 12 months, we have not sold Personal Information of California residents within the meaning of “sold” in the CCPA.
Rights under the CCPA
If you are a California resident and the CCPA does not recognize an exemption that applies to you or your Personal Information, you have the right to:

Please note that in order to protect your information, we will need to verify your identity before responding to any request to exercise your rights. In some cases we may need to collect additional information to verify your identity, such as a government issued ID.
How to Exercise Your Rights
First, you may wish to log into your account and manage your data from there. If you are a California resident to whom the CCPA applies, you may exercise your rights, if any, to other data by contacting us at legal@moji.com.
Under the CCPA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf by contacting us at legal@moji.com.
For requests by an authorized agent, we may require you to directly verify your identity with us, and confirm with us that you provided the authorized agent permission to submit the request.

By clicking “Accept”, you consent to the cross-border transfer of your information to any country where we have databases or affiliates.

Your Rights
Consent Revocation
You may revoke consent that you have previously given for the collection, use and disclosure of your Personal Information, subject to contractual or legal limitations. To revoke such consent, you may terminate your account or you can contact legal@moji.com. This may affect our provision of the Application to you.
Access
You have the right to access your Personal Information by logging into your account. You can access your Personal Information by logging into your account or making a request in writing to legal@moji.com. We may require further information to verify your identity, which information will only be used for that purpose.
Correction
You have the right to correct any of your Personal Information that is inaccurate. You can access your Personal Information by logging into your account. If you believe we hold any other of your Personal Information and that information is inaccurate, please contact us at legal@moji.com.
10.4、Malaysia
Parental and Guardian Consent
In the event you are agreeing to the Privacy Policy in order for a minor (a person under the age of 18) to access and use the Application, you hereby consent to the provision of Personal Information of the minor to be processed in accordance with the Privacy Policy and you personally accept and agree to be bound by the terms in the Privacy Policy. Further, you hereby agree to take responsibility for the actions of such minor, and that minor’s compliance with the Privacy Policy.
How We Store and Share Your Personal Information
In relation to Users in Malaysia, our servers are located in Singapore and you consent to the transfer of your data outside of your country.
Rights of Data Subjects
Right of access: You have the right to request access to and obtain a copy of the Personal Information that we have collected and is being processed by or on behalf of us. We reserve the right to impose a fee for providing access to your Personal Information in the amounts permitted by law.
When handling a data access request, we are permitted to request certain information in order to verify the identity of the requester to ensure that he/she is the person legally entitled to make the data access request.
We will comply with data access requests within the time periods as stipulated under Malaysian data protection laws.
Right of correction: You may request for the correction of your Personal Information. When handling a data correction request, we are permitted to request certain information in order to verify the identity of the requester to ensure that he/she is the person legally entitled to make the data correction request.
Right to limit processing of your Personal Information: You may request limiting the processing of your Personal Information by using the contact details provided in the Privacy Policy. However, this may affect our provision of the Application to you.
